The following terms and conditions ("Terms") govern your use of the website www.haymarketsac.com, and any content made available from or through this website, including any sub-domains thereof ("Website”). The Website is owned, managed and operated by Haymarket SAC Publishing (India) Private Limited ("HSAC").
Please read the following Terms as these constitute a legally binding agreement between you and the HSAC regarding your browsing, access and use of the Website and any functionalities, features, information, contests, services, products offered by the HSAC including but not limited to delivery of specialized content, subscription based services (print and/or digital), content and premium services via the Website, any mobile or internet connected device or otherwise ("Service")
Your access or use of the Website or Services shall mean that you accept and agree to be bound by these Terms as applied to your use of the Website and Service and you are deemed to have read and understood all of its contents and implications. You also represent and warrant to the HSAC that you are at least eighteen (18) years of age or above and are capable of entering into a legally binding agreement under the laws of India as well as performing and adhering to these Terms and that you agree to be bound by the following terms and conditions. While individuals under the age of eighteen (18) years may access and use the site, they shall do so only with the involvement & guidance of their parents and/or legal guardians.
If you do not agree to these Terms, please do not use the Service.
HSAC reserves the right, at its sole discretion, to change, modify, add or remove any portion of these Terms, in whole or in part, under which the Service is offered, including but not limited to the charges associated with the use of the Service, from time to time, without prior notice, by posting such amended Terms on the Website. Such variations become effective immediately upon the posting of the amended Terms on the Website. By continuing to use the Service you will be deemed to accept such amendments/changes. You should therefore check the Website from time to time to review the latest Terms.
The Website, Services and the Company Content are protected by copyright, trademark and other applicable laws. Company Content means HSAC’s content, including but not limited to, HSAC’s trademarks and logos made available through the Website and Services, excluding Third Party Content and User Submissions.
The trademarks, logos, service marks and trade names ("Trademarks") displayed on the Website or Service made available through the Website are registered and unregistered Trademarks of HSAC and are protected under copyright, design, patents, trade dress, trademark law and any other laws protecting intellectual property. All such rights are reserved to HSAC or their licensors.
You acknowledge that ‘Autocar India’, ‘Autocar Professional’, ‘What Hi-Fi?’, ‘Stuff India’, and ‘Printweek’ and any other brands or logos that belong to HSAC within the Service are HSAC’s trademarks and that you may not use them without written permission from HSAC.
Nothing contained on the Website should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Website without the written permission of HSAC or the third party that may own the applicable Trademark. Your misuse of the Trademarks displayed on the Website or on or through any of Website's services is strictly prohibited.
You agree not to remove, obscure or alter any copyright, patent, trademark or other proprietary rights notices appearing on the Service. You may not sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from the Content on the Service or HSAC trademarks.
All Trademarks not owned by HSAC that appear on the Website or on or through the Website’s services, if any, are the property of their respective owners. HSAC claims no ownership interest in any Third Party Content and expressly disclaims any liability concerning those materials.
You may register yourself on the Website, free of cost, by completing the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You will receive a registration confirmation email. To complete your registration and activate your account you will have to follow the link provided in the registration confirmation email.
HSAC shall retain your registration information after cancellation or withdrawal of your registration as required under applicable law(s).
You can choose a subscription based Service of the term and duration offered by HSAC as listed on the Website. The subscription price for our subscription based Service will be made clear to you on our Website during the sign-up process. The subscription prices shall be determined by HSAC, in its sole discretion. Unless otherwise indicated, prices stated on Website are inclusive of applicable taxes, including but not limited to Goods and Services Tax (GST) or other applicable taxes. Rates and offers valid in India only.
All offers (including the complimentary gifts) on the website and the application are limited period offers. Eligibility for any discounts is ascertained at the time your subscription and cannot be changed during the term and subsistence of your subscription.
You hereby agree and acknowledge that contents on Website may become subject to technical glitch and/or errors including but not limited to price list, subscription details etc. If HSAC incorrectly or due to a technical glitch or error state a price to you whether online or otherwise, we are not obliged to provide you with a subscription at that price, even if we have mistakenly accepted your offer to buy a subscription at that price, and we reserve the right to subsequently notify you of any pricing error. If we do this, you may cancel the subscription based Service without any obligation to us and we will refund you any money you have paid us in full, or you may pay the correct price. If you refuse to exercise either of these choices then we may cancel your access to our subscription based Services and will refund you any money you have paid us in full. HSAC always endeavours to act in good faith in determining whether a genuine pricing error has occurred or not.
When you purchase a subscription, you must provide HSAC with complete and accurate information and payment details required by HSAC. By submitting payment details you promise that you are entitled to purchase a subscription using those payment details.
Payment for subscription can be done to Haymarket SAC Publishing (India) Private Limited by Cheque, Demand Draft, Credit Card, Debit Card, Net banking, UPI or Direct Transfer using NEFT or RTGS or Cash deposit. HSAC does not accept cash payment.
The bank details, for processing the payment for subscription by Cheque, Demand Draft or Direct Transfer using NEFT or RTGS or Cash deposit, would be sent to you on your registered email. The payment for subscription using the above-mentioned payment methods should only be made after placing the order on the Website, and not any time before that. After making the payment through any of the above-mentioned payment methods, please send a confirmation email to mahesh@haymarketsac.com or call us 022 – 69047589/90/97 or Whatsapp us 8657042527 along with Order Number, Payment Date and Payment details (UTR Number for NEFT or Cheque/DD number & date). In the event NEFT or RTGS payment has not been completed for any reason whatsoever, the subscription will not be processed. You will be solely responsible for ensuring that the payment for your order is made to the designated bank account details. HSAC will not be responsible or liable for any loss or damage whatsoever caused due to any error in this regard. All applicable payments, charges, costs, taxes and levies in relation to the NEFT / RTGS will be payable by you.
In case you have the subscription form which comes with each magazine, please send the filled up form along with the Cheque or Demand Draft in favour of ‘Haymarket SAC Publishing (India) Private Limited’ and mail the same to Haymarket SAC Publishing (India) Private Limited, Voltas Premises, F Block, T. B. Kadam Marg, Chinchpokli East, Mumbai – 400033, Maharashtra, India. HSAC would not be responsible for postal delays, transit losses or mutilation of the subscription form or Cheque or Demand Draft.
For processing the payment for subscription by Credit Card, Debit Card, Net banking or UPI you will be directed to the payment gateway website. You agree to pay in full the prices (including applicable taxes) for any purchases you make either by Credit Card, Debit Card, Net banking or UPI concurrent with your online order or by other payment means acceptable to HSAC and the payment gateway.
In case of transaction failure from the payment gateway but you have been billed for the same, kindly contact the payment gateway helpdesk for resolution. In most cases the money is refunded back to the source by the payment gateway itself. HSAC cannot be held responsible for such cases.
Subscription to the subscription based Services commences immediately on the realisation of payment of the subscription fees and there can be no cancellation once an account is active for the subscription based Services.
If we do not receive payment authorization or any authorization is subsequently cancelled, we may immediately terminate or suspend your access to your subscription based Service or your entire access to Services on Website. In suspicious circumstances we may contact the issuing bank/payment provider and/or law enforcement authorities or other appropriate third parties. If you are entitled to a refund under these terms and conditions, we will credit that refund to the card or other payment method you used to submit payment, unless it has expired in which case we will contact you. HSAC uses third party payment gateway services for receiving payment from Users for its subscription based Services.
To access the subscription based Services, you will be asked to enter your individual user name and password, as chosen by you during your subscription. Therefore, HSAC does not permit any of the following:
As a part of the subscription, you will be receiving newsletter and marketing e-mail/SMS communications pertaining to your subscription or offers from HSAC, unless you specifically indicate your need to unsubscribe to the communication.
In case you want to buy more than 50 subscriptions, please drop an e-mail to subscribe@haymarketsac.com and we will revert with further steps.
HSAC does not sell past issues of their Print magazines. However, if you wish to purchase any of past issues of the digital magazines, you can get subscribe for the said issues separately. Please note that the selection of past issues available for viewing purposes to subscribers will be as per the sole discretion of HSAC and may change from time to time.
If you have not received our magazine or gift, please report the missed/non-delivery of the same through an email to subscribe@haymarketsac.com within 1 (one) month of the expected magazine/gift delivery date (for dates refer to your subscription activation mail), so that HSAC can sort out the issue with HSAC’s delivery partner. Under such circumstances, HSAC will re-dispatch the missed copies to you on a best effort basis at no additional cost, but no refunds, whether full or partial, or subscription extension requests shall be entertained.
Gifts, if out of stock, will be replaced with alternate gifts of equal or more value, at HSAC’s own and sole discretion. The expected gift delivery date will be communicated to you on your registered e-mail ID.
At HSAC’s end, HSAC ensures that every magazine is printed, packaged and delivered in excellent condition. However, as a rare case, if a magazine arrives in a damaged condition, then HSAC advises you to kindly check with the courier or post office delivering it. Please do get in touch with HSAC through an email to subscribe@haymarketsac.com in case of such an occurrence, along with a photograph of the damaged magazine/gift. In this case, HSAC would be happy to replace a damaged copy/gift immediately, at no additional cost to you.
For information about HSAC´s policies and practices regarding the collection and use of your personally identifiable information, please read the Privacy Policy as available on the Website. The Privacy Policy is incorporated by reference and made part of these Terms. Thus, by agreeing to these Terms, you agree that your presence on the Website and use of the Services are governed by HSAC’s Privacy Policy in effect at the time of your use.
Subject to your compliance with the Terms herein, HSAC hereby grants you a personal, limited, non-exclusive, non-transferable, freely revocable license to use the Services for the personal and non-commercial use only.
Content on the Site and/or the Services is provided to you ‘AS IS’ and ‘AS AVAILABLE’ basis for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. Any unauthorized use of the contents or the Services will result in termination of the limited license granted by the Company and cancellation of your membership. Use of Site or the Services for any unauthorised purpose may result in severe civil and criminal penalties.

You shall not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Website. Any unauthorized use of the contents or the Service, including but not limited to making unauthorized copies or unpermitted distribution or transmission of content, will result in termination of the limited license granted by HSAC and cancellation of your membership. Use of Website or the Services for any unauthorised purpose may result in severe civil and criminal penalties.

The Linked Sites are not under the control of HSAC and HSAC is not responsible for these Linked Sites and their contents or availability, including without limitation any link contained in such Linked Site, or any changes or updates to such Linked Site. HSAC does not represent or warrant that the contents of any such Linked Sites is accurate, compliant with any laws including the laws of India, or compliant with copyright or other intellectual property laws. HSAC is not responsible for webcasting or any other form of transmission received from any Linked Site. HSAC is providing these links to you solely for your convenience, and the inclusion of any link does not imply endorsement or representation by HSAC of the site or any material found on them or any results that may be obtained from using them or any association with its operators. If you use these Linked Sites, you leave the HSAC Website. Any reliance on the contents of a Linked Sites is done at your own risk and you assume all responsibilities and consequences resulting from such reliance.
Your subscription will automatically be discontinued at the end date of your subscription. In case of Digital services you can renew the same only after the end of your current subscription. However, in the case of Print magazine, you may renew your subscription at any time before your current subscription ends by signing into your account to manage your subscription. A reminder notice will be sent to you before each renewal stating the rate that will apply for the renewal period.
You do not have any right to cancel your subscription or any part of it until the end of your current subscription period.
HSAC shall retain your registration information after cancellation or withdrawal of your registration as required under applicable law(s).
HSAC reserves the right to suspend or terminate your subscription if you breach these Terms, with or without notice and without further obligation to you.
If HSAC reasonably believes that an account and password is being used / misused in any manner, HSAC shall reserve the right to cancel access rights immediately without notice, and block access to all users from that IP address. You agree to notify HSAC immediately of any unauthorized use of your account or any other breach of security. HSAC will not be liable for any loss that you may incur as a result of someone else using your password or account, however, you could be held liable for losses incurred by HSAC or another party due to someone else using your account or password.
If messages sent to an email address provided by you and associated with your account are returned as undeliverable or wrong address; HSAC reserves the right to terminate your account immediately with or without notice to you and without any liability to you or any third party.
HSAC may also suspend or terminate your subscription if we are prevented from providing Services to you by circumstances beyond our control. HSAC will give you at least 15 days' notice of this, if possible. If we do so, then we will have no further obligation to you except for a refund of the unexpired period of your paid subscription. This means that we will refund you with any amounts that you have paid us in advance that relate to any remaining and unexpired period of your subscription.
HSAC reserves the right, in its sole discretion, to change, suspend or discontinue, temporarily or permanently, any aspect of the Website or the Services at any time without notice or liability.
HSAC and/or its suppliers make no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services and related graphics contained on the Website for any purpose. The information, software, products, and services included in or available through the Website may include inaccuracies or typographical errors.
HSAC and/or its suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, services and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title and non-infringement.
HSAC does not warrant that the Service will be compatible with all hardware and software which you may use. HSAC shall not be liable for damage to, or viruses or other code that may affect, any equipment (including but not limited to your mobile device), software, data or other property as a result of your download, installation, access to or use of the Service or your obtaining any material from, or as a result of using, the Service.
HSAC does not endorse, warrant or guarantee any third party product or service offered through the Service and will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services. HSAC shall not be liable for the actions of third parties or for any claim or damage or loss that may arise on account of availing of goods or services offered by any third party that may have been accessed through the Service.
To the maximum extent permitted by applicable law in India, in no event shall HSAC and its affiliates' directors, officers, employees and agents be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Website, with the delay or inability to use the Website or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the Website, or otherwise arising out of the use of the Website, whether based on contract, tort, negligence, strict liability or otherwise, even if HSAC or any of its suppliers has been advised of the possibility of damages. In no event shall the total aggregate liability of the protected entities to you for all damages, losses, and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) arising from the terms and conditions or your use of the web site exceed, in the aggregate, the amount, if any, paid by you to HSAC for your use of the Website or Service.
You agree to defend, indemnify and keep indemnified HSAC and its affiliates' directors, officers, employees, sub-contractors, agents, representatives, licensors, vendors, suppliers and service providers and hold them harmless from any and all claims, liabilities, costs and expenses, including attorneys' fees, arising in any way from your use of the Website, your placement or transmission of any message, content, information, software or other materials through the Website, or your breach or violation of the law or of these Terms. HSAC reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with HSAC's defence of such claim. These defence and indemnification obligation will survive these Terms and your use of and access to the Service.
Neither Party shall have any liability for any interruption or delay, to access the Website or Service due to Force Majeure Event. For the purposes of this clause, ´Force Majeure Event´ means any event or circumstance or combination of events and circumstances which is reasonably beyond the control of the party affected thereby and which causes or results in default or delay in performance by such affected party of any of its obligations under this agreement and includes an act of God, Government order, war, hostilities, civil commotion, epidemics, lockdowns, strikes, lockouts and other industrial disputes etc.
You and HSAC agree that any cause of action arising out of or related to use of the Website or the Services must commence within one (1) year after the cause of action accrues otherwise, such cause of action will be permanently barred.
Rights and obligations under the Terms which by their nature should survive will remain in full effect after termination or expiration of the subscription.
Any express waiver or failure to exercise promptly any right under this agreement will not create a continuing waiver or any expectation of non-enforcement.
HSAC may from time to time run competitions, promotions, etc. through their Website or Service. These are subject to separate terms and conditions that will be made available in each instance.
You hereby consent that HSAC reserves the right to collect information for the purpose of quality testing and feedback and may call/communicate with you in relation to the same.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and HSAC as a result of this agreement or use of the Website.
You may not transfer to anyone else, either temporarily or permanently, any rights to use the Services or any part of the Services. Any attempt by you to do so is void. HSAC may assign, transfer, delegate and/or grant all or any part of its rights, privileges and properties hereunder to any person or entity.
To the maximum extent permitted by law, this agreement is governed by the laws of India and you hereby consent to the exclusive jurisdiction and venue of courts in Mumbai, Maharashtra, India in all disputes arising out of or relating to the use of the Website or Service. Use of the Website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.
HSAC's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of HSAC's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Website or information provided to or gathered by HSAC with respect to such use.
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and HSAC with respect to the Website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and HSAC with respect to the Website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
In the event that you are exposed to Content on the Service which you believe is unlawful, obscene, defamatory, libelous, threatening, pornographic, hateful, racially or ethnically offensive, or damaging towards any religion, ethnic group, club, organisation, company or individual, HSAC encourages you or visitor to report such material to HSAC to Mr. Hital Vyas, the Grievance Officer, at hital@haymarketsac.com, so as to enable HSAC to take appropriate action.
